Purposes of the processing

infarAMA processes personal data for the sole purpose of its business operations.

This policy applies to all infarAMA sites and staff.

 

Legal foundation for the processing

Personal data is processed based on Article 6.1. ((a) consent, (b) required for the implementation of an agreement, (c) required to satisfy a legal obligation, (f) required for the protection of our legitimate interest in entrepreneurship) of the General Data Protection Act.
Insofar as the processing of personal data takes place based on Article 6.1. a) (consent), the data subject always has the right to withdraw the given consent. Given the fact that InfarAMA processes personal data in small quantities and mainly on behalf of its customers there is no legal obligation to appoint a DPO.

 

Transfer to third parties

If required to achieve the set purposes, personal data will be shared with external receivers which are linked directly or indirectly to infarAMA.

infarAMA guarantees that these receivers have also taken the necessary technical and organizational measures for the protection of personal data.

 

Retention period

Personal data may be stored by infarAMA as long as necessary to satisfy legal requirements and to achieve the above purpose, unless a data subject exercises its right to have the data removed as stated in the next paragraph.

 

Right to inspection, improvement, deletion, limitation, objection and transferability of personal data

At all times, the data subject has the right to (1) access its personal data; (2) request the correction of its personal data if and to the extent it can prove such data is inaccurate; (3) request the deletion of its personal data if the conditions of the General Data Protection Regulation are not met; (4) limit the processing of its  personal data based on Article 6.1 (f), (5) object to the processing of  its personal data on grounds relating to its personal situation and/or request its restriction; and (6) request a copy of its personal data in a structured, commonly used and readable format.

Visiting the website without entering any data

Our IT systems automatically gather a number of different forms of data when you visit the website. This mainly comprises technical data (e.g. browser type, type of operating system and time of site visit). This data is gathered automatically as soon as you visit our website and is required to establish a connection between you and our website. Some of this data is gathered to enable the website to function without issue. Other data may be used to analyse your browsing activity. We do not combine this data with your personal data. This technical data remains anonymous.

This gathering of data takes place on the basis of our legitimate interest (Article 6 (1) (f) GDPR).

Data when using the contact form (incl. newsletter subscription)

We offer visitors to our website (who wish to contact our company, or request information about our services, or wish to subscribe to our newsletter) the opportunity to use our contact form. This form requires the disclosure of personal data such as the user’s full name, email address, telephone number or also the company name. This data is not published and only serves the purpose of communication between you and our company or the sending of the requested information.

Data that users can enter in the contact forms is voluntary. This data is gathered on the basis of your consent (Article 6 (1) (a) GDPR).

We send our newsletter on the basis of the consent of the recipient (Article 6 (1) (a) and Article 7 GDPR or on the basis of legal permission (Section 7 (3) UWG). The login process is recorded on the basis of our legitimate interest (Article 6 (1) (f) GDPR).

Data when applying for a job

In order to service you as a potential candidate for infarAMA, we collect personal details from you. These details may include names, addresses, telephone numbers, email addresses, education, employment history, CV’s and any other information required to provide you with job placement opportunities and services. infarAMA collects and uses your personal information to deliver the job seeking services you have requested. Your information will only be used for the purpose of matching your profile with potential job opportunities.

Providing your personal data as part of the application process is voluntary. This data is gathered on the basis of your consent (Article 6 (1) (a) GDPR). However at different stages in the recruitment processes we also have other lawful grounds for processing your data such as legitimate interest and compliance with our legal obligations and where it is necessary for the performance of contracts related to the recruitment process.

Social media plug-ins

On our website, we have integrated social media plug-ins to access our company profiles on the social media platforms Facebook, Instagram and LinkedIn using the so-called two-click method to protect you, as our website visitor. This means that if you visit our website, initially no personal data will be passed on to the providers of these plug-ins. Only when you click one of the plug-ins, further processing of your personal data by the respective social media provider may occur.

Specific for our social media profiles:

Infarama maintains publicly accessible profiles on the social media platforms Facebook, Instagram and LinkedIn to raise awareness for our company, more specifically for our services, campaigns, company news and to interact with our visitors. In this context and based on Art.6 §1 of the GDPR, the underlying marketing purpose is to be regarded as a legitimate interest.

Both Infarama and the social media provider are partly responsible for the data collection and processing when you visit our social media profiles. When you visit our social media profile pages, certain information about you is processed.

On the one hand, Infarama processes your actions and interactions with our social media profile pages when you visit them, e.g. the content of your messages, inquiries, posts or comments that you send to us or if you like or share our posts, as well as, your publicly visible profile data , e.g. name of your social profile and your profile picture. In regards to the use of pictures on our social media pages, Infarama reserves the right to publish ‘non-targeted’ images, i.e. images that represent a general, spontaneous and non-posed atmospheric shot, without prior permission, for marketing purposes for its services, activities and operations.

On the other hand social media providers can analyse your user behaviour, when you visit our social media profiles.  If you have your own user account in the social media platform and are logged in to this account, all data related to your visit will be assigned directly to your existing account. The social media providers store data collected about you as user profiles and can use them for advertising and market research purposes. Your personal data can also be recorded if you are not logged into your social media account or do not have one at all. In this case, data is collected via cookies that are stored on your end device or by recording your IP address.

In other words, Infarama has no influence or control on the data processing activities of social media providers, who themselves are responsible to ensure compliance with data protection. To learn more about the data processing activities of the social media providers, their respective privacy policies should be consulted in order to protect your privacy.

In any case, you can limit the processing of your personal data by changing your privacy settings on the social media platform.
